AILA Liaison Requests that USCIS Accept H-1B Petitions with Proof of LCA Filing
On August 21, 2009, AILA-USCIS and AILA-SCOPS Liaison submitted a Memorandum to Donald Neufeld, Acting Associate Director, Domestic Operations, Barbara Velarde, Chief, Service Center Operations, and Robert Kruszka, Deputy Chief, Service Center Operations, asking USCIS to reinstate the practice of allowing the filing of an H-1B Petition with proof of filing of the ETA 9035 Labor Condition Application (LCA) under certain circumstances.
AILA Liaison will post any updates on InfoNet, including any official response received from USCIS. In the meantime, AILA Liaison reminds members that USCIS' current and continuing policy is to reject or deny H-1B Petitions which do not contain a duly certified LCA.
